Terms of Service
The ground rules for creating mascots and animated moments with Mascotale.
1. Using Mascotale
These terms govern your use of Mascotale’s website, workspace, and AI-assisted generation service (“Mascotale”, “we”, or “us”). By creating an account or using the generation service, you agree to these terms. If you do not agree, do not use those services. You must be at least 18 and able to enter into a binding agreement. If you act for a business, you must be authorized to do so.
Questions about these terms can be sent to hello@mascotale.com. Our Privacy Policy explains how information is handled.
2. Accounts and access
Sign in using an account you are authorized to use. You are responsible for keeping access to your Google account secure and for activity you authorize through your Mascotale account. Tell us promptly if you suspect unauthorized access. Do not access another user’s workspace or attempt to bypass ownership checks, rate limits, pack allowances, or other safeguards.
3. What the service provides
Mascotale uses app information and your creative instructions to generate character concepts, starting poses, and animations. AI results can contain visual errors, inconsistent details, unwanted motion, or similarities to other work. Review all outputs, transparency, file formats, and suitability before publishing them. We do not guarantee exclusivity, copyright protection, trademark availability, app-store approval, or a particular creative or commercial result.
Download and keep copies of assets you need. The service is not a permanent archival or backup service. Features, providers, formats, and availability may change.
4. Free concepts, packs, and upgrades
The current offer starts with four free mascot concepts. Animation packs contain 1, 5, 9, or 18 moments, as shown in the product. Each moment includes a starting-pose PNG and one matching 5-second video generation. Packs apply to one app and one selected mascot; they are not subscriptions.
You can plan moments individually. Review the plan and starting pose before submitting a video. A tailored starting pose and up to one additional pose attempt are included before video submission. Requesting a new performance after submission uses another moment. Downloads, refreshes, and status checks do not consume moments. Editable Lottie files are not included.
Upgrading an eligible pack for the same app and mascot costs the displayed price difference and adds the difference in moments, not a second full pack. Existing saved assets remain associated with the workspace. Account-wide and site-wide safety limits may temporarily restrict generation even when a pack has unused moments. These limits do not create an entitlement to unlimited retries or automated use.
5. Current test checkout and future payments
Checkout is currently a no-charge test. Displayed prices describe the intended pack offering; activating a test pack does not charge a card or create a paid subscription. Test generations use real providers and may use a draft pipeline. Test access and allowances may be limited or discontinued and have no cash value.
Any future paid purchase must be expressly confirmed in a paid checkout displaying its price, currency, applicable taxes, and relevant purchase and refund terms. Test activation does not authorize a later charge. No blanket “no refunds” rule is imposed by these terms; mandatory consumer rights remain unaffected.
If a generation fails or you have a purchase issue, contact hello@mascotale.com with the app and task details. Do not repeatedly submit the same task while its status is uncertain. A failed or unsatisfactory result does not automatically trigger a replacement generation; we will review the issue and any remedy required by the applicable purchase terms or law.
6. Your content and generated assets
You retain any rights you hold in submitted app information, prompts, images, and other material. You must have the rights and permissions needed to submit it and have it processed by the service and its providers. Public availability of an image, logo, character, or app listing does not automatically grant permission to reuse it.
You authorize us to host, copy, process, and transmit your submitted content and generated assets as needed to provide, secure, and support the service, including sending relevant material to AI providers. This permission does not transfer ownership of your original content to us.
As between you and Mascotale, we do not claim ownership of your generated assets. You may use them in your apps and related commercial materials to the extent permitted by applicable law and any applicable third-party rights or provider restrictions. We cannot grant rights that neither you nor we hold. AI output may not qualify for intellectual-property protection and other users may receive similar results. You are responsible for checking rights before use.
Mascotale’s brand, website design, software, and service materials remain the property of their respective owners. Access to the service does not grant ownership of those materials.
7. Acceptable use
Do not use Mascotale to create illegal, exploitative, deceptive, or rights-infringing content; impersonate others or imply false endorsements; expose personal information without permission; upload malware or secrets; interfere with the service; or evade safety controls through multiple accounts or automated requests. Do not submit content involving sexual exploitation of children or other unlawful harm. We may reject requests or restrict access to protect users, providers, and the service.
8. Third-party services and availability
Mascotale depends on authentication, hosting, and AI providers. Their outages, policy restrictions, or processing failures can delay or prevent delivery. Except where applicable law requires otherwise, the service and AI outputs are provided as available, without a promise of uninterrupted access, error-free output, or fitness for every purpose. Nothing here excludes warranties or remedies that cannot legally be excluded.
9. Suspension, closure, and disputes
We may suspend or restrict access where reasonably necessary to address misuse, security risks, legal obligations, or provider requirements. Where appropriate and practicable, we will explain the restriction. You can stop using Mascotale at any time and request account deletion by email.
Contact us first with any dispute so we can try to resolve it. These terms do not require arbitration, waive class-action rights, or remove any mandatory consumer rights or access to courts available under applicable law. Responsibility for losses is determined under applicable law; nothing excludes liability that cannot lawfully be limited.
10. Updates
We may revise these terms as the service develops. Updated terms will show their effective date, and we will provide notice or seek agreement where required for material changes. Changes will not retroactively authorize charges or remove rights arising from completed purchases. For help, contact hello@mascotale.com.
